2. Scope and acceptance
These Terms and Conditions of Sale apply to orders placed by consumers on www.dr-rubber.fr. Sales to business customers may be subject to specific terms.
Before confirming the order, the customer must be able to read the applicable Terms and Conditions of Sale. The applicable version is the one made available to the customer at the time of ordering. Confirming the order constitutes acceptance of that version.
3. Products
Dr. Rubber sells, among other products, reconditioned tyres. The essential characteristics of each product are specified on its product page, including size, load index, speed rating, season and any other characteristics advertised for the product concerned.
Photographs are provided for illustration and do not replace the essential characteristics expressly stated on the product page.
Products are offered subject to stock availability. If a product becomes unavailable after an order is placed, the customer is informed as soon as possible and the amounts paid for that unavailable product are refunded, unless the customer accepts an alternative.
4. Prices
Prices are stated in euros including all taxes. The total amount payable by the customer and any additional charges are shown before final confirmation of the order.
Standard delivery is free in mainland France when buying two or more tyres, excluding Corsica and islands not connected by a bridge. Where delivery charges apply, the amount is shown before the order is confirmed.
5. Ordering
The customer selects the products, checks the cart, provides the information needed to fulfil the order and chooses from the delivery and payment options offered.
Before final confirmation, the customer must be able to check the order details and total price and correct any errors. The order confirmation function must clearly indicate that the order entails an obligation to pay.
After confirmation, an order confirmation is sent to the customer on a durable medium.
6. Payment
Payment is made at the time of ordering using the methods offered on the website. Accepted payment methods and any delivery restrictions are indicated no later than the start of the ordering process.
7. Delivery
Products are delivered to the address given by the customer when ordering. The applicable delivery period or date is indicated to the customer before the order is concluded.
If delivery is delayed, the customer benefits from the rights provided by the applicable provisions of the French Consumer Code.
The customer is asked to check the apparent condition of the parcel and products on delivery and promptly report any problem. Failing to note reservations with the carrier does not deprive the consumer of statutory guarantees.
8. Right of withdrawal
Under Article L.221-18 of the French Consumer Code, consumers have fourteen days from receiving the goods to exercise their right of withdrawal without having to give a reason.
Consumers may exercise this right using the online withdrawal function available on the website, the model form at the end of these Terms and Conditions of Sale or any other unambiguous statement expressing their wish to withdraw.
After communicating the decision, the consumer must return the products without undue delay and no later than fourteen days after that communication.
When exercising the right of withdrawal, the customer bears the direct cost of returning the products.
The consumer is responsible for any reduction in the product's value resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning. Fitting or use therefore does not automatically result in the loss of the right of withdrawal, but any reduction in value actually caused may be taken into account under the conditions provided by law.
9. Return and refund arrangements following withdrawal
Products must be returned properly protected to: Dr. Rubber - SAS EKODRIVE, 147 route du Moulin, 31600 Lamasquère, France. The return must allow the order to be identified, particularly through the order number.
Where withdrawal is valid, Dr. Rubber refunds all amounts due, including standard delivery charges where they were actually charged, without undue delay and no later than fourteen days from the date on which Dr. Rubber is informed of the decision to withdraw.
Dr. Rubber may withhold the refund until the products have been recovered or the customer has provided proof of dispatch, whichever occurs first.
The refund is made using the same payment method used for the original transaction, unless the customer expressly agrees to another method that incurs no fees. Additional costs resulting from the express choice of a more expensive delivery method than the standard option offered are not refunded.
10. After-sales returns, lack of conformity and errors attributable to Dr. Rubber
If the product received does not match the order, has a defect that may be covered by a statutory guarantee, or an order preparation error is attributable to Dr. Rubber, the customer should contact customer service at contact@dr-rubber.fr, stating the order number and the nature of the problem.
Where a return is necessary to bring the product into conformity under a statutory guarantee or because of an error attributable to Dr. Rubber, the consumer does not bear the cost. Dr. Rubber provides the arrangements for covering the return.
11. Statutory guarantees
SAS EKODRIVE is the business responsible for statutory guarantees. To exercise these rights, contact: 147 route du Moulin, 31600 Lamasquère, contact@dr-rubber.fr, +33 9 87 75 81 20.
INFORMATION ON STATUTORY GUARANTEES
Consumers have two years from delivery of the goods to claim under the statutory guarantee of conformity if a lack of conformity becomes apparent. During this period, consumers need only establish the existence of the lack of conformity, not the date on which it became apparent.
The statutory guarantee of conformity entitles consumers to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience.
If goods are repaired under the statutory guarantee of conformity, consumers receive a six-month extension to the original guarantee.
If the consumer requests repair but the seller requires replacement, the statutory guarantee of conformity is renewed for two years from the date the goods are replaced.
Consumers may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if:
1° The business refuses to repair or replace the goods;
2° The goods are repaired or replaced after more than thirty days;
3° Repair or replacement causes significant inconvenience to the consumer, particularly where the consumer ultimately bears the cost of taking back or collecting non-conforming goods, or the installation costs of repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
Consumers are also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. In this case, consumers do not have to request repair or replacement first.
Consumers are not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are unavailable for use while being repaired or replaced suspends the remaining guarantee period until the repaired or replacement goods are delivered.
The rights mentioned above arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the exercise of the statutory guarantee of conformity in bad faith may incur a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
Consumers also benefit from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund in exchange for returning them.
12. Dr. Rubber commercial warranty
Where advertised for the product concerned, Dr. Rubber provides a four-year commercial warranty covering the repair carried out when reconditioning the tyre. This commercial warranty is additional to statutory guarantees and does not limit them.
It covers defects attributable to the repair carried out by Dr. Rubber. It does not cover normal tyre wear or new damage unrelated to that repair, including a new impact or puncture, an accident, incorrect fitting, improper use, unsuitable pressure or overloading.
To make a claim, the customer should contact contact@dr-rubber.fr, stating the order number and information identifying the problem. Dr. Rubber may request the return of the tyre for examination. Where the defect is recognised as covered by the warranted repair, the customer does not bear the costs necessary to exercise this warranty.
13. Liability and use
The customer must comply with the specifications compatible with their vehicle, the applicable load index and speed rating, fitting rules, recommended pressure and the manufacturer's instructions. These Terms and Conditions of Sale are not intended to exclude or limit any liability that cannot legally be excluded or limited.
14. Personal data
Data needed to process orders and manage customer relations is processed in accordance with the applicable regulations. Detailed information is provided in the Privacy policy available on the website.
15. Complaints and consumer mediation
Any complaint may first be sent to Dr. Rubber at contact@dr-rubber.fr or by post to SAS EKODRIVE, 147 route du Moulin, 31600 Lamasquère.
After first making a written complaint to Dr. Rubber, and if no amicable solution is reached, consumers may contact the consumer mediator responsible for Dr. Rubber free of charge:
CM2C - Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris
Website: www.cm2c.net
16. Applicable law and disputes
These Terms and Conditions of Sale are governed by French law, without depriving consumers of any more protective mandatory provisions that may apply to them. In a dispute, consumers may bring proceedings before the competent court under the applicable legal rules.
17. Changes to the Terms and Conditions of Sale
Dr. Rubber may change these Terms and Conditions of Sale for future orders. A change published after an order has been concluded does not change the contractual terms applicable to that order.
18. Model withdrawal form
Complete and send this form only if you wish to withdraw, unless you use the website's online withdrawal function.
